No! Definitely not. In most cases, when insurance adjusters receive notice of a new claim, they immediately begin calling the injured person. They typically come across as very nice and will tell you they are concerned about your injuries and are sorry you were hurt. Once they befriend you, they almost always ask if they can take your statement. Sometimes they even want to record it. It is a good idea to refuse to give a statement and immediately call an attorney. I almost always tell my clients not to give a statement (there are exceptions to this general rule in rare cases).
The adjuster will ask questions about the accident – where, when and how it happened- and will want to know about your injuries. If you say something “off the cuff” and without the advice of an attorney, you might end up saying something that will be used against you later when you try to settle your case. Remember, the insurance adjuster is not your friend. Their job and their only goal is to save the insurance company money – at your expense.
In order to best protect yourself and your claim, it is a good idea to call an attorney as soon as you can after the accident. An experienced personal injury attorney will be able to guide you through the process and help preserve you claim so you can maximize your recovery.
