Possibly. There is no law in Florida that says you have no claim if you do not immediately go to the doctor. When there is an auto accident, people are often shaken up, confused, and even scared about what just happened. Sometimes they are just a “little sore”, but they don’t want to go spend hours at the hospital because they think the pain will go away and they will be better the next day. Many times, this happens and the person goes on with their life as if nothing happened. However, more often, the pain gets even worse over the next few days. It is important to see a doctor as soon as possible if you believe you have been injured.
First and foremost, you owe it to yourself to get checked out and have your injuries evaluated by a doctor. You need to know the extent of your injury – how serious is it, will it go away soon, will it affect your ability to work?
Second, going to the doctor will document your injury and help you when it is time to pursue a claim against the at-fault party. If you have an injury but do not go see a doctor for weeks or months after the injury, it will make it very difficult for your attorney to settle your case. If you have not been to the doctor fairly soon after an accident, the insurance adjuster will typically not believe you sustained any injuries. Common sense would tell you that people who have an injury will usually go see a doctor. Not doing so is likely to affect the value of your claim.
